PROBATE
Probate in Texas is the legal process to distribute a person’s property after they die. With court approval, the will (if one exists) is validated, the debts are paid, and the rest of the property passes to the beneficiaries and/or heirs of a deceased person (decedent). If there is no will, the estate may still have to go through probate to determine heirship and distribute the decedent’s assets to the heirs according to Texas law. Not every estate requires full probate—many can be handled through simplified procedures such as small estate affidavits, muniment of title, or affidavits of heirship—but larger or more complex estates often need formal administration.
